INFORMATION ON THE RIGHT OF WITHDRAWAL
CONSUMER CODE (ARTT. 49 AND SS.)

This pre-contractual information is also part of the general terms and conditions of the contract. The right of withdrawal applies only to online sales, sales by telephone and contracts negotiated outside the gallery’s business premises to buyers acting as consumers or natural persons purchasing works for purposes not related to their own business activity, pursuant to and for the purposes of the Consumer Code referred to in Legislative Decree no. 206/05 and subsequent amendments thereto.

The Buyer referred to this statement is always to be understood as a consumer.

The Buyer has 14 days from receipt of the work to view the same and to exercise the right to withdraw from the purchase, without having to provide any reasons.

In the event that the Buyer decides to exercise the right of withdrawal referred to in art. 52 of the Consumer Code, must give immediate notice to the Galleria Michelangelo by e-mail to the e-mail address galleriamichelangelo@pec.it or info@galleriamichelangelo.it with return receipt or registered letter with return receipt.; after that, the work must be returned in the same condition it was duly received and with the same packaging method it was sent; the relative costs and risks of the transport will be borne by the Buyer, including insurance. For international shipments the payment of taxes and customs charges will be charged to the Buyer. Payment of the refund by the Gallery will be made after receipt of the work in the above-mentioned conditions.

At the time of delivery, the work shall be accompanied by a pro-forma certificate of authenticity; Once the withdrawal period has elapsed without the same having been exercised, as indicated above, the original document will be sent to the Buyer.

If the work delivered shows damage/ defects not found at the time of purchase, the Buyer must immediately contact the Gallery specifying and documenting the truthfulness and bona fide of what found, the price of the works, returned due to damage or defect, if actually present and not attributable to any fact to the Buyer, will be fully refunded, including shipping costs for the return of the work.

Any variation in the perception of the pictorial, sculptural material orf the shade of colour of the work compared to the perception of the work viewed at a distance, is to be considered natural and legitimate, so that, in no case will be taken into account as a defect, being subject to variables such as the type of screen, TV, smartphone or tablet.

Once the 14-day period for the right of withdrawal has elapsed, the Michelangelo Gallery will not be obliged to accept any request for return.
